Dealing with the legalities of starting a home-based business could be one of those "cringing" matters, but it is absolutely necessary to protect yourself and your business.

To prevent this from happening, begin by setting up a legal business structure. It could be a sole proprietorship, a partnership, a corporation, or a limited liability company.
If your home-based operation will be selling products or services, then you need to apply for a business license. Some states do not require this, but you should check first to be certain.
From the point you start your business, understand that your tax conditions will change. Your tax filings will also be different and you may need to consult with a tax professional.
Another area that could result in legal issues if it is not addressed early on is insurance. Unless you are already covered, you should have health, dental, and life insurance policies. As you search for a provider, you could check to see if you are eligible for COBRA to hold you over until you locate a provider.
The last issue for home-based businesses that we're going to look at is zoning laws. Your city or county, depending on where you live, determines zoning laws. You may never encounter zoning issues if your home-based business doesn't have employees or walk-up trade.
However, problems could arise if you have outside employees coming into your home or if your business interacts directly with the public. Be aware that neighbors may report you to a zoning board if they suspect you to be running an unauthorized business out of your home. They may notice employees entering and exiting your house, customers taking up excess parking space, or additional noise coming from your house.
Also take into consideration what goods or services you are offering. Most issues only occur if your products involve chemicals or something that would require special allowances and regulation.
Because something as small as putting a sign in your yard for your business could violate a zoning law, you need to know what you can and can't do. Starting a home-based business is not easy, but to make the process smoother on yourself, research your state, city, and county laws to make sure you are abiding accordingly.
